License Agreement
To download a lesson from the GIS Exchange, you must read and agree to the following terms:
1. PUBLIC DOMAIN
If the contributing Author expressly states the lesson and related materials (hereinafter referred to as "Lesson") are being placed in the public domain, then the Lesson may be freely used and redistributed, is provided as "AS-IS" without warranty of any kind, and there is no technical support provided by the Author.
2. LICENSE AGREEMENT
If the contributing Author intends to retain copyright ownership in the Lesson but make the Lesson available to the GIS Exchange user community, then the following license agreement shall apply.
» Reservation of Ownership and Grant of Rights
This is a license agreement (hereinafter referred to as the "Agreement") and not an agreement for sale. The contributing author (hereinafter referred to as "Author") retains exclusive rights, titles, and ownership not granted herin to the copy of the Lesson licensed under this Agreement, and grants you (hereinafter, referred to as "Educator") a personal, nonexclusive, nontransferable, worldwide, royalty-free license to use, copy, edit, modify, merge, incorporate, and/or prepare derivative work(s) of the Lesson(s) with any new information, and thereafter the license right to demonstrate, reproduce, redistribute, and publicly display and perform the derivative work(s) embedding the Lesson(s) to Educator's students for their own personal use. All rights not specifically granted in this Agreement are reserved to the Author. In the event Educator transfers a copy of the unmodified Lesson(s) to another party, Educator expressly agrees to always include this Agreement file with all copies of the unmodified Lessons.

Creative Commons Attribution-Share Alike 3.0 United States License.
» Disclaimer of Warranty
Educator expressly acknowledges that the Lesson(s) are unsupported educational material and that no technical support shall be provided to Educator by the Author.
THE LESSON(S) ARE PROVIDED "AS-IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, BY STATUTE OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE AUTHOR DOES NOT WARRANT THAT THE USE OF THE LESSONS SHALL BE UNINTERRUPTED OR ERROR FREE. EDUCATOR BEARS ALL RISK AS TO THE QUALITY AND PERFORMANCE OF THE LESSONS.
» Exclusive Remedy and Limitations of Liability
IN NO EVENT SHALL AUTHOR BE LIABLE TO EDUCATOR FOR COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST PROFITS, LOST SALES OR BUSINESS EXPENDITURES, INVESTMENTS, OR COMMITMENTS IN CONNECTION WITH ANY BUSINESS, LOSS OF ANY GOODWILL, OR FOR ANY INDIRECT, SPECIAL INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THIS AGREEMENT OR USE OF THE LESSON(S), HOWEVER CAUSED, ON ANY THEORY OF LIABILITY, AND WHETHER OR NOT THE AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
» Governing Law
This license is governed by the laws of the United States of America and the state laws of which Author is a domiciled resident or citizen without reference to conflict of laws principles.
» Entire Agreement
The parties agree that this Agreement constitutes the sole and entire agreement of the parties as to the matter set forth herein and supersedes any previous agreements, understandings, and arrangements between the parties relating hereto when Educator assents to be bound by these terms and conditions by clicking the "I Accept" button below.
